We believe that technology should be used to create opportunities, promote prosperity, and improve quality of life. To ensure that our services are used in accordance with our Core Values and mission, we have established this Acceptable Use Policy (the “AUP”). This AUP outlines activities that are prohibited in relation to everyone’s use of RapidCents services and is in conjunction with the RapidCents Terms of Service (“Terms of Service”) available at https://rapidcents.com/terms-of-services/. Any capitalized terms not otherwise defined have the meaning set out in the Terms of Service.

We may modify the AUP at any time by posting a revised version at https://rapidcents.com/acceptable-use/. By continuing to use the Services or access your Account after a revised version of the AUP has been posted, you agree to comply with the revised AUP. In the event of a conflict between the AUP and the Terms of Service, the AUP will take precedence, but only to the extent necessary to resolve the conflict.

We reserve the right to remove any Account Content, suspend or terminate your Account or access to the Services, without prior notice, if you engage in activities that violate the AUP or Terms of Service. We may monitor or investigate any Account Content and your use of the Services for compliance with the AUP and the Terms of Service. Our determination of whether a violation of the AUP or Terms of Service has occurred will be final and binding, and any action taken with respect to enforcing the AUP or Terms of Service, including taking no action at all, will be at our sole discretion.

Prohibited Content

You may not use the Services or other Rapidcents infrastructure to offer goods, services or Account Content that:

• Exploits, abuses or presents children in a degrading or sexual manner;
• Harasses, bullies, defames or threatens any individual or group; 
• Condones or promotes hatred or violence;
• Contravenes or facilitates contraventions of the law;
• Infringes on the intellectual property rights of others;
• Transmits, hosts or promotes malware or phishing;
• Relies upon, enables or encourages deceptive commercial practices;
• Contains personally identifiable information, sensitive personal information, or confidential information without consent;
• Promotes or enables self-harm;
• Transmits unsolicited commercial messages;
• Implies or promotes funding of, or membership in, a terrorist organization;

Such activities are strictly prohibited.

Prohibited Businesses

In order to ensure that our services are provided in accordance with the applicable laws, regulations and card brand policies, RapidCents requires that all merchants operating within our platform operate within the laws of their jurisdiction. Any product or service not listed here may not be provided in conjunction with our services and may result in the immediate termination of your account. All new accounts are subject to conditions and approval by RapidCents and its partner banks as well as ongoing reviews after approval. This list is subject to change without notice, so please contact us if you are unsure whether your business is compliant.

Financial

• Collection agencies, credit restoration firms, and debt refinancing specialists
• Consumer bankruptcy lawyers, if their main practice area is consumer bankruptcy
• Debt resolution companies
• Identity theft protection services
• Payment aggregators and facilitators
• Primary money service businesses with 40% or more activity coming from currency dealing or exchange, check cashing, issuance, selling or redeeming of traveler’s checks, money orders, or stored value, or money transmission
• Virtual currency dealers such as Bitcoin
• Entities that issue bearer shares
• Investment services
• Payday lenders and automobile title lenders
• Third-party payment processors
• Bill payment services
• Real Estate down payments, mortgage payments

Personal Services

• Fortune telling including tarot card readers and mystics
• For-profit adoption

Technology

• Game console circumvention devices
• Remote technical support (without two years of established processing history),
• High-risk cyberlockers
• Prepaid phone cards or services
• Social media services like pay for followers, likes or subscriptions
• In-game items, currency, or credits (unless the merchant is the operator of the digital world)
• Website hosting services

Adult

• Adult entertainment, escort services, and sexual encounters
• Pornography involving minors is strictly prohibited. Terms such as “lolita”, “pedo”, and “preteen” are not tolerated
• Internet gambling
• Government owned state lottery merchants in the US are also prohibited

High-Risk Businesses

• Telemarketing, infomercial sales
• Multi-level marketing, and pyramid schemes
• Counterfeit goods
• Online, mail order, or telephone order guns and firearms (excluding accessories)
• Discount travel clubs, travel related direct marketing arrangements
• Penny auctions
• Drop shipping, freight forwarding
• Event or event promotions requiring payment in advance
• Major airlines, charter airlines, cruise lines, bus tours, car rental agencies, package tour operators, tour operators, travel agencies, travel clubs, and travel wholesalers
• Lead generation activities

Medical and Drugs

• Internet, mail or telephone order, or pharmacy referral services (where fulfillment of medication is performed without a physical visit)
• Online, mail order or telephone order e-cigarette/vape (including devices, equipment, and liquids), tobacco and nicotine product sales (except physical store sales)
• Telemedicine, except where practiced by a licensed practitioner
• Wonder drugs
• Supplements or compounds banned by Health Canada or the United States Food and Drug Administration
• Drug paraphernalia
• Chemicals, drugs, and compounds used for intoxicating effect (except alcohol)

Miscellaneous

• Orders for firearms, assault weapons, or related accessories that are illegal
• Orders for arcades, amusement machines
• Unregistered charities, for-profit third party charitable fundraisers
• Businesses with a delayed delivery of more than one year on more than 25% of sales volume
• Any product, service or activity that is illegal in your jurisdiction or your customer’s jurisdiction

Payment Restrictions

RapidCents Bank Payments are not to be used for Transactions related to

• Motor Vehicle Dealers (including sales or leasing)
• Charities or Fund-Raising Organizations
• Educational Institutions
• Auctions
• Precious Metals or Gems.
